1. Acceptance of terms

By creating an account or using SeniorGuardCare ("Service", "we", "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of service

SeniorGuardCare is a care coordination platform that helps families and professional caregivers manage medications, appointments, health documents, and communication for elderly or dependent individuals ("seniors"). The Service is not a medical provider, does not give medical advice, and is not a substitute for professional medical, legal, or financial guidance.

3. Accounts and eligibility

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must provide accurate, complete, and current information during registration.

4. Subscription plans and billing

SeniorGuardCare offers free and paid subscription plans. Paid plans are billed monthly in advance. You may cancel at any time; access continues until the end of your current billing period. We do not provide refunds for partial months. Prices are shown in US dollars and are subject to change with 30 days notice.

Usage beyond your plan's included limits (e.g., additional residents on the Agency plan) is billed as overage at the rates shown on the billing page.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload content that is abusive, defamatory, obscene, or violates third-party rights
  • Attempt to gain unauthorised access to the Service or other accounts
  • Use automated means to scrape, extract, or abuse the Service
  • Resell or sublicence the Service without our written permission

6. Health information and HIPAA

SeniorGuardCare stores sensitive health information about individuals in your care. You are responsible for ensuring you have appropriate consent from the individuals whose information you enter. We implement industry-standard security measures to protect this data, but we are not a HIPAA "covered entity" or "business associate" unless separately agreed in writing. Do not rely on SeniorGuardCare as your sole record-keeping system for regulated healthcare environments.

7. Data and privacy

Our Privacy Policy explains how we collect, use, and protect your data. You own your data. You may export or delete your data at any time from the Settings page.

8. Intellectual property

The Service and its original content, features, and functionality are owned by SeniorGuardCare and protected by intellectual property laws. You retain ownership of content you upload. By uploading content you grant us a limited licence to store and display it to you and your authorised care team members.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR ANY HARM RESULTING FROM YOUR USE OF THE SERVICE, INCLUDING MISSED MEDICATION REMINDERS OR APPOINTMENT ALERTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENIORGUARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE PRIOR 12 MONTHS.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from Settings. Upon termination, your data will be deleted within 30 days, except where retention is required by law.

12. Changes to terms

We may update these Terms at any time. We will notify you by email and via the Service at least 30 days before material changes take effect. Continued use after that date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
